I. SERVICE PROVIDER DETAILS
Art. 1. (1) These General Terms and Conditions (“GTC”) govern the relationship between MAGICLINE ENERGY SYSTEMS EOOD (МЕДЖИКЛАЙН ЕНЕРДЖИ СИСТЕМС ЕООД), UIC 207913813, VAT No. BG207913813, with registered office and management address at Sofia, 56 Vitosha Blvd., fl. 1, office 1, e-mail: info@magiclineenergy.com, website: magiclineenergy.com (the “Operator”), and every natural person who uses the “MGLBG Charge” mobile application and/or the electric vehicle charging service (the “User”).
The Operator is a charge point operator within the meaning of Regulation (EU) 2023/1804: it operates publicly accessible charging stations in the Republic of Bulgaria and provides the charging service to end users, and it also develops and provides the “MGLBG Charge” mobile application (iOS and Android).
Supervisory authorities: Commission for Consumer Protection (www.kzp.bg); Commission for Personal Data Protection — Sofia 1592, 2 Prof. Tsvetan Lazarov Blvd., www.cpdp.bg; National Revenue Agency.
II. DEFINITIONS
Art. 2. For the purposes of these GTC: 1. the “Application” is the “MGLBG Charge” mobile application for iOS and Android; 2. a “Charging Station” is a publicly accessible installation of the Operator with one or more charging points; a “Charging Point” (“connector”) is an interface capable of charging one vehicle at a time; 3. a “Session” is the process from the start to the end of charging, for which the delivered energy is metered and the price is calculated; 4. an “Account” is the User’s personal profile in the Application; 5. a “POS Terminal” is a payment terminal at the charging station, accepting contactless card payments, with a built-in fiscal device under Ordinance No. N-18; 6. a “Pre-authorisation” is the temporary blocking of a maximum amount approved by the User on their payment card, from which only the price actually due is collected after the session; 7. the “Tariff” is the applicable price per kilowatt-hour (kWh) for the respective station, shown in the Application before the session.
III. SUBJECT MATTER AND CONCLUSION OF THE CONTRACT
Art. 3. (1) These GTC govern the use of the Application, the Account, the charging service at the Operator’s charging stations, payment and payment documents.
The contract is a distance contract within the meaning of Art. 45 et seq. of the Consumer Protection Act (“CPA”) and is concluded in Bulgarian. Texts in other languages are for convenience only; the Bulgarian text prevails.
The contract is deemed concluded when the User completes registration and expressly accepts the GTC in the Application. The Operator stores the accepted version and the date and time of acceptance. Each individual Session is a separate service provided under this framework contract.
The pre-contractual information under Art. 47(1) CPA is provided through the Application and these GTC, which are permanently available in the Application and on the Operator’s website.
IV. REGISTRATION AND ACCOUNT
Art. 4. (1) The charging service through the Application is available to registered users only. Registration is free of charge and proceeds in steps: telephone number and acceptance of the mandatory documents; confirmation by a one-time code (SMS or, where SMS cannot be delivered, e-mail); personal data and password; e-mail confirmation by a one-time code.
Only a natural person with legal capacity who has reached 18 years of age may be a User. The User provides true and current data and keeps it up to date.
The User keeps their password confidential and does not make the Account available to third parties. Actions performed through the Account after successful authentication are deemed the User’s actions, unless unauthorised access is reported immediately.
A one-time code is required when signing in from a new device. The User may mark a device as “trusted” and remove it from their profile at any time.
V. THE APPLICATION
Art. 5. (1) The Operator grants a free-of-charge, non-transferable, non-exclusive right to use the Application for personal, non-commercial purposes.
The Application provides: a map and list of stations with prices, power output, connectors and real-time availability; starting and monitoring of Sessions; history and payment documents; vehicle management; support; management of the Account and consents.
The Operator may require updates for security or compatibility reasons and may temporarily restrict access for maintenance or in emergencies, informing users through the Application.
The following are prohibited: use contrary to any legal act; circumventing security measures; automated access without consent; decompiling or modifying the Application beyond what the law permits.
VI. STARTING A SESSION AND PAYMENT AT THE POS TERMINAL
Art. 6. (1) A Session is started through the Application: the User selects a station and an available Charging Point (including by scanning the QR code on the station), reviews the Tariff, sets a maximum amount for the Session (the “approved amount”) and confirms.
Before charging begins, the User pays by contactless card payment at the POS Terminal at the station, whereby a pre-authorisation of the approved amount is placed on the card. Charging starts only after successful authorisation; if declined, the Session does not start and nothing is owed. The waiting time for payment is limited (indicatively up to 2 minutes), after which the request is cancelled automatically at no cost to the User.
By starting the Session, the User expressly requests that the service begin immediately, before the expiry of the withdrawal period under Art. 50 CPA, and confirms having been informed that upon full performance of the service they lose their right of withdrawal pursuant to Art. 57, item 1 CPA.
Charging Points cannot be reserved; they are used according to actual availability.
VII. COURSE AND COMPLETION OF THE SESSION
Art. 7. (1) During the Session the Application displays charging data (energy delivered, power, amount accrued; for DC stations — also vehicle data, where available).
The Session ends upon: stopping by the User through the Application; termination by the vehicle; reaching the approved amount (charging stops automatically so the price does not exceed it); technical interruptions; termination by the Operator under Art. 12.
After completion, the Operator calculates the final price from the metered delivered energy (kWh) and the Tariff and collects only that amount from the blocked amount; the difference is released. Where no energy has been delivered, the blocked amount is released in full and no fiscal receipt is issued.
Metering data is recorded by the station and stored by the Operator; the Session records serve as evidence in the event of a complaint.
VIII. PRICES AND TARIFFS
Art. 8. (1) The price is based solely on the delivered energy: the price per kWh under the station’s Tariff multiplied by the metered quantity. The Operator applies no start fee, per-minute price, idle fee or subscriptions; if introduced, they will be announced in advance and shown before a Session starts.
All prices are in euro (EUR), VAT included. The final price matches the amount in the fiscal receipt.
The applicable price per kWh is shown in the Application (list, map, station screen) before a Session starts and is displayed at the charging station in accordance with Art. 5(4) of Regulation (EU) 2023/1804.
Tariffs may differ between stations and apply equally to all users under equal conditions. A Tariff change applies only to Sessions started after its publication and does not affect ongoing Sessions.
IX. PAYMENT, PRE-AUTHORISATION AND REFUNDS
Art. 9. (1) Payment is made by payment card at the POS Terminal at the station. The card payment is processed by the terminal and the acquiring bank as payment service provider; the Operator does not receive or store card numbers or other card data. Cash is not accepted.
The blocked amount is not a paid price — it secures payment for the energy actually delivered. After the Session only the final price is collected and the remainder is released immediately at the Operator’s instruction; the time until the released amount becomes available again depends on the issuing bank and the card scheme (usually several hours to several business days).
Upon a declined authorisation the Application notifies the User, showing the reason where available. The Operator is not liable for declines attributable to the issuing bank.
A refund is due where: an amount exceeding the final price was collected; an amount was collected for a service not provided; or a complaint is upheld with a price reduction or termination for the Session. Requests are made under Art. 15; approved refunds are made to the card used. If a blocked amount remains unduly unreleased, the Operator instructs its release without undue delay after verification.
An interrupted Session gives no refund right for the energy delivered up to the interruption; the undelivered part is not charged.
X. FISCAL RECEIPT AND INVOICE
Art. 10. (1) For every Session with delivered energy a fiscal receipt is issued via the fiscal device built into the POS Terminal, in accordance with Ordinance No. N-18, with QR data for verification with the National Revenue Agency. The receipt, including as a PDF reproducing the fiscal elements, is available in the Application in the session history.
- An invoice is issued at the User’s request under Art. 113 of the VAT Act, after the necessary details are provided to info@magiclineenergy.com.
XI. USER OBLIGATIONS
Art. 11. (1) The User must: use the station for its intended purpose and per the displayed instructions; use an undamaged, compatible cable/connector and a compatible vehicle; not damage the equipment and immediately report damage or hazards; park properly and only for the duration of charging; not endanger third parties; pay the price due.
- The User is liable for damage culpably caused to the Operator’s equipment or to third parties.
XII. OPERATOR OBLIGATIONS; INTERRUPTIONS
Art. 12. (1) The Operator maintains the stations in good technical condition and provides the service with the care of a good merchant, in compliance with safety requirements. Uninterrupted availability of a specific station or point is not guaranteed; availability information is indicative until a Session starts.
Upon an interruption for technical reasons, the Session ends and only the energy actually delivered is charged; the User is notified through the Application, including of the reason where available.
The Operator may temporarily take a station out of service for maintenance, repair or by order of a competent authority, and may terminate an ongoing Session in the event of immediate danger, technical malfunction or unlawful use; in the latter case, if the reason is not attributable to the User, only the price of the delivered energy is due.
XIII. LIABILITY
Art. 13. (1) The Operator is liable for damage from culpable non-performance of its obligations in accordance with applicable law.
The Operator is not liable for: damage from incompatibility or malfunction of the User’s vehicle or cable; damage from use in breach of Art. 11; force majeure; interruption of the electricity supply by the grid operator, unless the Operator could have prevented it with the care of a good merchant.
Nothing in these GTC limits the Operator’s liability for intent or gross negligence, for death or personal injury, or the User’s rights under mandatory provisions of law.
XIV. RIGHT OF WITHDRAWAL
Art. 14. (1) The User may withdraw from the framework contract (the registration) without reason and at no cost within 14 days of its conclusion — by an unambiguous statement to the Operator (including deleting the Account or by e-mail) or via the standard form annexed to these GTC. Upon withdrawal, payment is due for Sessions already provided.
- For individual Sessions the right of withdrawal does not apply pursuant to Art. 57, item 1 CPA: the service is fully performed and performance begins immediately at the User’s express prior request with the confirmation under Art. 6(3). This does not affect the right to complain.
XV. COMPLAINTS AND DISPUTES
Art. 15. (1) The User may contact the Operator: through the “Support” function in the Application (including directly from a session screen — the enquiry is automatically linked to the session and payment); at info@magiclineenergy.com; or in writing at the management address. The Operator replies without undue delay and no later than within 14 days.
In the event of non-conformity of the service (e.g. an amount collected without charging having started, undelivered energy charged, divergence from the announced price), the User may lodge a complaint under Art. 125 CPA and claim conformity, a price reduction, or termination for the Session and a refund. The complaint states its subject, the preferred remedy and contact details; the Operator’s records are taken into account of its own motion.
If an amount was collected although charging never started, it is refunded in full. The automatic stop upon reaching the approved amount is not a non-conformity.
The User may complain to the Commission for Consumer Protection (www.kzp.bg) and use alternative dispute resolution through the general conciliation commissions at the CCP (Art. 182 CPA). The European ODR platform ceased operation on 20 July 2025 pursuant to Regulation (EU) 2024/3228.
Disputes may be referred to the competent Bulgarian court. Bulgarian law applies; consumer claims are brought under the Civil Procedure Code, including at the consumer’s permanent address.
XVI. SUSPENSION AND CLOSURE OF THE ACCOUNT
Art. 16. (1) The Operator may temporarily restrict or suspend an Account upon reasonable suspicion of abuse, non-payment, or breach of Art. 5(4) or Art. 11, informing the User of the reason unless the law does not permit this.
- The User may close their Account at any time from the Application (with password and one-time code). Closure is final: personal data is deleted or anonymised immediately, while legally required financial and fiscal records are retained for the statutory periods, separated from the person’s name — details in the Privacy Policy. Closure is not performed during an active Session; obligations for services already provided remain.
XVII. AMENDMENTS TO THE GTC
Art. 17. (1) The Operator may amend these GTC upon changes in legislation, new functions or services, changes in the payment infrastructure, or for organisational and technical reasons.
- The new version is published in the Application; users are notified upon first opening after publication and, for material amendments, also by e-mail. The new version applies to the User after its express acceptance in the Application; until acceptance, access to the functions (except reviewing the documents and managing the Account) may be restricted. The history of accepted versions is available in the profile.
XVIII. PERSONAL DATA
Art. 18. The Operator processes personal data as a controller in accordance with Regulation (EU) 2016/679 and the Personal Data Protection Act. Details are set out in the Privacy Policy, available in the Application and on the Operator’s website.
XIX. FINAL PROVISIONS
Art. 19. (1) The invalidity of an individual clause does not affect the validity of the remaining clauses.
Matters not regulated herein are governed by Bulgarian law and directly applicable EU law, including Regulation (EU) 2023/1804.
These GTC apply from 21 October 2026.
